1. Accepting terms and conditions of use

Use of this site implies acceptance of the terms and conditions below. We recommend reading them carefully. APC REPER S.R.L. may at any time amend these terms and conditions without prior notice. The latest version can be found by accessing the "Terms and conditions of use" link in the "Information" menu from the site footer.

 

2. Copyrights

The entire content of the www.apcreper.ro (images, texts, graphics, symbols, web graphics, scripts, programs and other data - is the property of APC REPER SRL and its suppliers and is protected by the Copyright and Intellectual and Industrial Property Protection Laws. The use of any of the items listed above without the written permission of APC REPER SRL will be punished according to applicable laws. 3. Definitions and terms

SELLER - S.C. APC REPER S.R.L., legal entity of Romanian nationality with registered office in Soceni, no.107, Caras - Severin county. Order number in the Trade Register J11 / 454/2004, fiscal code RO16497772.

BUYER - any individual / company that makes an account on the site and performs an order.

USER - any individual / company registered on the Site who, through the completion of the Account creation process, has given its consent to the site-specific clauses in the “Terms and conditions of use” section.

CLIENT - the individual / company who has or obtains access to the CONTENT by any means of communication provided by APC REPER S.R.L. (Electronic, telephone, etc.) or under an existing use agreement between APC REPER S.R.L and that requires the creation and use of an Account.

CONTENT

  • All information on the Site that can be accessed, viewed or otherwise accessed by using electronic equipment;
  • The content of any email sent to Buyers by the Seller by electronic means and / or any other means of communication available;
  • Any information communicated by any means to the Buyer by an employee of the Seller, according to the contact information, whether or not specified by the Seller;
  • Information about the products and / or tariffs practiced by the Seller in a given period;
  • Seller's data, or other privileged data.


ACCOUNT - the section of the Site consisting of an email address and a password that allows the Buyer to submit the Order and contains information about the Customer / Buyer (Order History, billing addresses, etc.).

ORDER - an electronic document that acts as a form of communication between Seller and Buyer through which the Buyer submits to the Seller through the Site its intention to purchase the products on the Site.

CONTRACT - represents the distance contract concluded between Seller and Buyer, without the simultaneous physical presence of Seller and Buyer.

SITE - the domain www.apcreper.ro and its subdomains.

SPECIFICATIONS - all specifications and / or product descriptions as specified in their description.

NEWSLETTER - way of information, electronic or electronic mail (e-mail), on the products and / or promotions carried out by the Seller in a given period, without any commitment by the Seller with reference to the information contained therein.

4. Registration on site

You agree that the provision of services or products will begin immediately after all required registration formalities have been completed. The information provided must be correct, accurate and complete. By calling for registration, you are obliged to provide us with the correct name, address and other useful information. To correct or update this information, go to "My Personal Information" in the "My Account" menu.

By accessing your account and using your personal password, you are responsible for all actions arising from the use of your account. APC REPER S.R.L. Can not be held responsible for errors resulting from user negligence regarding the security and confidentiality of their account and password.

If we find that the data entered is not true, inaccurate or incomplete, we reserve the right to suspend or terminate your account.

 

5. Order

The Customer / Buyer can place Orders on the Site by adding the desired products to the shopping cart, then complete the Order by choosing the delivery method and payment method. Once added to your shopping cart, a product is available for purchase as long as there is a stock available for that. Adding a product to your shopping cart, in the absence of completion of the Order, does not entail the registration of an order, or the automatic reservation of the product.

By completing the Purchase Order, the Buyer agrees that all of the data provided by the buyer, which is necessary for the purchase process, is accurate, complete and true at the time of placing the Order.

Depending on availability, the products can be:

  • In stock - we have more than 3 pieces in stock
  • Limited stock - we have less than 3 units in stock
  • In stock - This product is not yet in stock, but it is possible to be in the supplier's warehouse. If you register an order for a product that has its "in stock supplier", one of our sales consultants will contact you as soon as possible to let you know when we will deliver your product.
  • On order - the product is not available in stock in our warehouse and we currently have no information about its availability in the supplier's stock. But if you place an order for a product that is "on order", one of our sales consultants will check the availability of the product in the supplier's stock and will contact you to let you know when we will deliver your product.
  • Exhausted stock - this product is no longer in stock in our warehouse or in store.
  • Currently unavailable - We can not currently purchase the product because it is not in the supplier's stock.


 
6. Contract conclusion

With the registration of an order on the apcreper.ro website, the buyer / client agrees with the communication method used by the company APC REPER S.R.L. - either by phone or email.

The contract is concluded only when the tax invoice is issued and not when the order is issued or the automatic confirmation of receipt of this order is issued. Automatic delivery of the order confirmation is NOT equivalent to the conclusion of the contract between the seller and the buyer.

Seller reserves the right to cancel or modify the Buyer's Purchase Order upon prior notice to the Purchaser, without any subsequent liability of any party to the other, or without any party claiming the other damages in the following cases:

  • availability of products in stock;
  • non-acceptance by the issuing bank of the Buyer's card of the transaction in the case of online payment;
  • invalidation of the transaction by the card processor agreed by the Seller, in case of online payment;
  • the data provided by the Customer / Buyer on the Site is incomplete and / or incorrect;
  • If the order is canceled by the Seller, if the payment of the products was made online with a bank card, the Seller will return the Buyer's money within 10 working days.
  • If a Product ordered by the Buyer can not be delivered by the Seller, the latter will inform the Customer / Buyer of this fact and will return the value of the product to the Buyer's account within 7 (seven) days from The date on which the Seller acknowledged this fact or the date on which the Buyer expressly expressed his intention to terminate the Contract.

7. Delivery

Deliveries are made within a minimum of 2 hours and a maximum of 20 days, depending on the availability of the products in stock, once all the order details have been validated. All the information / ways used to describe the products on the site is not a contractual obligation on the part of the Seller, these being used exclusively for presentation, delivery, stocks, prices.

8. Prices

The prices of the products presented on the site can be expressed in LEI (RON) or in Euro (EUR) and include VAT and environmental tax (if applicable to ordered products). The user can choose the currency for displaying product prices in the currency menu at the top left of the screen. The euro rates are calculated at the official rate of the National Bank of Romania (EUR / LEU) on the day of the site visit.

The purchase price of the products presented on the invoice will be the same as the one presented on the site at the time of the order.

The term of validity of the prices and the offer is the one mentioned on the website www.apcreper.ro. In the absence of a mention, the prices can be changed at any time. Also, the prices may change daily, depending on the evolution of the exchange rate announced by the National Bank of Romania.

The price, payment method and payment term are specified in each order. The Seller will issue to the Buyer an invoice for the delivered products, the Buyer's obligation being to provide all the information required to issue the invoice in accordance with the legislation in force.

 

9. Invoice and Payment


The Seller will send to the Buyer the invoice for the Order containing the products sold by the Seller, exclusively in electronic format, by adding the invoice to the Buyer's Account or by e-mail to the e-mail address mentioned by the Buyer in his / her Account.

In order to correctly communicate the invoice relating to the Order, the Buyer has the obligation to update his account data every time and to access the information and documents relating to each Order in the Account.

By sending the Order, the Buyer expresses the agreement to receive the invoices in electronic format by adding them by the Seller to his / her Account via the electronic mail at the e-mail address mentioned in his / her Account.

 

Payment of products ordered according to these Terms and Conditions of Use may be made only in advance or at the latest on delivery of the products.

APC REPER S.R.L. Reserves the right, if suppliers of products so request, to require advance payment of part of the value of the products.

Payment in advance can be made through a payment order based on a pro forma invoice; Proof of payment must be sent to APC REPER S.R.L. To email vanzari@apcreper.ro. These orders will begin processing only after the advance has been collected.

If the amount paid in advance is greater than the value of the products ordered, the difference will be immediately returned to the customer.

If the amount paid in advance is less than the value of the products ordered, the customer will have to pay the difference at the time of delivery.

For this last situation, as for delivery payment, ordered products must be paid in full, otherwise delivery will not be made.

10. Returns

The buyer has the right to withdraw from the Contract, or to return a product, within 14 calendar days without invoking any reason and without incurring any costs other than the delivery costs.

Thus, according to OUG No. 34/2014, the return period for a product or waiver of a service expires within 14 days of:

  • the day on which the buyer enters into the physical possession of the last product - if the Buyer orders through a single order multiple products to be delivered separately
  • the day on which the buyer enters into the physical possession of the last product or the last piece - in the case of delivery of a product consisting of several lots or pieces


Customers will express their willingness to return the products purchased in writing at vanzari@apcreper.ro, to receive a written answer using the email address used or using the return form from the client account.

If the Customer / Buyer requests withdrawal from the Contract within the legal withdrawal period, he must return any gifts accompanying the product. In the event that the Purchase Order is paid, the Seller will reimburse the amount within 14 (fourteen) days of the Buyer informing the Seller of his decision to withdraw from the Contract. The amount will be returned via bank transfer.

Seller reserves the right to postpone reimbursement until receipt of the products.

The seller reserves the right to refuse to refund if the product received as a return does not meet the return conditions

Products ordered online or by telephone that have been picked up from the workstation do not benefit from return (they can be checked at the reception).

When selling the parts are sealed, it is not acceptable to return the parts with the deleted or destroyed seals !!!

It is not allowed to disassemble the piece, the returned piece is not missing !!!

Complaints about inconsistency between the goods and the invoice are accepted only if they have been notified within two days of delivery.

11. Product warranty

All products marketed by Seller are subject to warranty conditions in accordance with applicable laws and commercial policies of manufacturers.

New products are marketed in original packaging and come from sources licensed by each manufacturer.

For second-hand products, the warranty certificate is issued by Seller under the applicable second-hand product warranty.

The guarantee provided by APC REPER SRL for reusable parts is 30 days from the date of sale of the product to the consumer.

Products that have operating or manufacturing defects during the warranty period will be replaced by others provided they are returned within 30 calendar days, provided that they have been installed in an RAR Authorized Service.

If the piece was misplaced, the vendor's fault will be changed without shipping costs.

If the track is defective and there is another similar in stock, the track will be replaced.

If we DO NOT have another similar track, the equivalent of the song will be returned.

The seller is relieved of liability for the warranty in the following circumstances:

  • The piece has not been installed in an approved RAR service by type, make, model, or fitting has been made without the proper tools or devices, without respecting the working technology established by the vehicle manufacturer;
  • The part has failed due to incorrect installation or due to the use of other worn or damaged components as a whole;
  • The part was used for an application other than that indicated by the manufacturer;
  • The piece was not correctly identified due to the erroneous data being supplied by the purchaser or when the assembly was not compared to the replacement piece, then the mechanic finds that you need another piece altogether;
  • It is not acceptable to return the pieces that were wrongly ordered and the mechanic then finds that you need another piece altogether;
  • The part was used as a result of overloading and incorrect or inadequate maintenance of the vehicle, failure to carry out periodic inspections as recommended by the car manufacturer, the workshop who did the assembly did not perform the subsequent checks and adjustments according to the manufacturer's installation technology;
  • The track shows marks of bumps, scratches, bends, ruptures, deformations, or has undergone external factors in the normal operation process;
  • The customer mistakenly ordered the product or provided erroneous identification data;
  • The customer does not request the guarantee within the time limit specified in this certificate, or does not submit any of the documents listed below, or they are filled in incorrectly, incompletely or inappropriately;
  • The piece was used for other purposes or on vehicles other than those for which it was purchased;
  • Electronic parts (relays, control modules, sensors, resistors, etc.), oil-operated parts (camshaft, gears, gearboxes, etc.), power steering pumps and steering boxes have not been fitted to a representative of the manufacturer auto.
  • Upon completion of the repair, the car service unit did not perform the verification, calibration, adjustment required by the vehicle manufacturer;
  • The product has been incorrectly installed or with used worn parts
  • Wear or defect of the product is due to overuse, maintenance or periodic adjustments / checks;
  • The vehicle on which the product was mounted has been injured or has suffered damage caused by external, atmospheric or other factors (thermal, electrical, mechanical);
  • The vehicle on which the product was mounted has been used for purposes other than the manufacturer's intended purpose or has been exploited in inappropriate conditions: robot or towing, exceeded maximum admissible weight, sports competitions, rallies, or facilities and systems have been modified thereof;
  • Unauthorized installation of equipment / accessories other than equipment in the factory;
  • Damaging or destroying the product as a result of transport, handling, storage, storage, use, inappropriate handling or contact with aggressive chemicals or near heat sources;
  • The dismantling of parts or subassemblies of products, or the deterioration of seals affixed by the manufacturer, where appropriate;
  • The vehicle has faults in steering, braking, suspension, cooling, air conditioning, electrical, etc .;
  • Inadequate vehicle operation by: failure to perform the flow, exceeding the thermal regime, maximum permissible speed;
  • Product failure due to the presence of foreign bodies, dust, dirt in their operating areas (eg lubrication, hydraulic, intake, etc.);
  • Failure to observe the interval and the program of technical revisions set by the vehicle manufacturer;
  • The vehicle for which the product is intended is non-registered or the periodic technical inspection has expired prior to the occurrence of the warranty;
  • The piece has a natural wear and tear.

Parts covered by a warranty claim will be accompanied by the following documents:

  • Purchase invoice;
  • The warranty certificate;
  • Proof of fitting the piece to an approved RAR service by type, make and model;
  • The notice issued by an RAR Authorized Service describing in detail the failure;
  • The copy of the vehicle registration certificate with the number of km;
  • The copy attesting the validity of the vehicle's technical inspection.

THE WARRANTY DOES NOT MEET THE MANIFESTATION COSTS OR MATERIALS NECESSARY TO DISASSEMBLE AND REMOVE CASES OR ANY OTHER AUXILIARY COSTS.

ANY OTHER OBLIGATIONS THAT INDIRECT LOSSES ARE EXPRESSLY EXCLUDED.

12. Liability

The Seller may not be liable for damages of any kind that the Purchaser or any third party may suffer as a result of Seller's fulfillment of any of its obligations under the Order and for damages resulting from the use of Goods and Supplies after delivery and in particular for Their loss.

Seller does not assume responsibility for modifying, suspending or interrupting the site apcreper.ro, in whole or in part.

 

13. Advertising

The Newsletter is an electronic email (e-mail) regularly delivered by the Seller to the subscriber users who expressly and unequivocally agree on the terms and conditions set out in this regulation. Subscribing to the newsletter is done by filling out the newsletter form. Once subscribed, the user expressly and unambiguously agrees to all of these terms and conditions.

The user may request to unsubscribe from the Newsletter service by accessing the unsubscribe link displayed in the commercial messages received from the Seller. Repeating the receipt of the Newsletters does not imply giving up the acceptance for this document.

 

14. Litigation

Any litigation in connection with the performance of the contract will be resolved between the Seller and the Buyer / Client amicably, otherwise the parties may address the competent court at the Seller's registered office - S.C. APC REPER S.R.L., respectively Resita Judiciary.

 

Continuing your action implies the agreement with these "Terms and Conditions of Use".
